Grimsby seafood superbrand, The Saucy Fish Co, has secured an interim injunction from the High Court against the budget chain Aldi over a copycat product.
The similarity of packaging and product recipes of the German retailer's Saucy Salmon Fillets prompted complaints from the brand's owner Icelandic Seachill.
A verdict in favour of the Grimsby firm at a full court hearing later this year could see supermarkets forced to pull copycat products from shelves.
Aldi is among a number of retailers who have tried to attract customers by creating imitation products which copy the packaging design, names and colours from big brands.
The Saucy Fish Co said Aldi's Saucy Salmon Fillets infringed its trademark due to the similarity of its packaging and recipe.
Like The Saucy Fish Co, the supermarket's offering came in black packaging with a cardboard sleeve to the left of the pack featuring a cut-out fish shape.
The crème fraiche & watercress sauce, and chilli, lime & ginger sauce in Aldi's offerings were also said to be copies of the watercress & crème fraiche dressing, and chilli, lime & ginger dressing in the Saucy Fish Co products.
Commenting on the matter, Aldi's Managing Director of Corporate Buying Giles Hurley said Saucy Salmon Fillets was a trial product which had "reached the natural end of the trial period."
He added that the injunction was temporary and "no decision has been made regarding the upholding of the injunction."
The Grimsby-based brand has gone from strength to strength since its launch four years ago. Saucy Fish Co products arrived on the shelves of Waitrose stores nationwide earlier this year, while an initial launch in eight US states was announced in March.
