THE defence in the trial of Scartho man Wai Hong Tsang has told the jury that they should find key evidence relied on by the prosecution as "worrying".
Timothy Spencer QC, who represents Tsang, urged the jury at Lincoln Crown Court to give careful consideration to the evidence and accused the prosecution of not being able to back up theories with hard facts.
He said the evidence showed that between walking home from school and being killed, Tsang's former wife Mingzi Yang had changed her clothing which meant she had not been murdered immediately when she returned to the house as claimed by the prosecution.
Mr Spencer said that the prosecution were relying on some aspects of witnesses' evidence but wanted the jury to ignore other evidence given by the same witnesses which did not fit their case.
Tsang is alleged to have driven to the western outskirts of Lincoln and then cycled into the city where he murdered Ms Yang inside her home in Sincil Bank.
He admitted during his evidence that he initially lied about his whereabouts on the day of the murder but said he did not kill his ex-wife and had no reason to want her dead.
The jury has heard that Ms Yang's home had been burgled twice in the month before her death. The prosecution claim that Tsang murdered his wife and then took steps to make it appear as if a burglary had been carried out.
Mr Spencer said: "The scene looks like a burglary. The prosecution want it to be a staged, sham burglary but don't ignore the blindingly obvious. Could it be it looks like a burglary because it was?
"During the search of the house the police did not find a plastic bag containing several thousands of pounds described by Darren Grundy (Ms Yang's fiancé). We know she had that. She kept it in her bedroom. It had gone. Why?"
Mr Spencer urged the jury to return a verdict of not guilty adding: "The prosecution case depends upon a whole series of extraordinary coincidences.
"You can only convict if you are sure of his guilt. Sure means that you have to be sure forever because it is a forever decision."
Wai Hong Tsang, 33, of Bluebell Road, Scartho, Grimsby, denies the murder of Mingzi Yang on June 17 this year.
